How Do I Appeal A VA Claim Decision?

There are three main appeal paths, and choosing the right one matters.

How Do I Appeal A VA Claim’s Decision?

Start here 👇

1. Higher-Level Review (HLR)

This is the fastest and simplest appeal option.

A more experienced VA reviewer takes another look at your claim using the same evidence already submitted.

👉 You are not allowed to add new evidence.

Best for:

  • Clear VA errors
  • Misinterpretation of evidence
  • Incorrect rating decisions

What to do:

  • Request a Higher-Level Review
  • (Optional) Ask for an informal conference to explain the issue

2. Supplemental Claim

This is the most common and often the most effective appeal path.

You submit new and relevant evidence to support your claim.

👉 This is where many veterans win their claims.

Examples of new evidence:

  • Nexus letter
  • New medical records
  • Doctor statements
  • Lay statements

Best for:

  • Denied claims with missing evidence
  • Weak or no nexus (connection to service)
  • Adding stronger medical support

What to do:

  • Gather new evidence that strengthens your claim
  • File a Supplemental Claim

3. Board of Veterans’ Appeals (BVA)

This is the most formal (and slowest) option.

A Veterans Law Judge reviews your case.

👉 You can choose different review options:

  • Direct review (no new evidence)
  • Evidence submission
  • Hearing with a judge

Best for:

  • Complex cases
  • Long-standing denials
  • When other options didn’t work

What to do:

  • Choose the type of Board review
  • Submit your appeal to the Board

Which Appeal Option Should You Choose?

Here’s a simple way to think about it:

  • ❌ No new evidence, but VA made a mistake → Higher-Level Review
  • ✅ You have new evidence → Supplemental Claim
  • ⚖️ Complex case or multiple denials → Board Appeal

Important: Don’t Just Appeal—Fix the Problem

Most veterans lose appeals because they don’t address why they were denied.

Before you file:

  • Read your VA decision letter carefully
  • Identify exactly what’s missing (diagnosis, nexus, severity, etc.)
  • Choose the appeal path that actually fixes that issue

The Bottom Line

If your VA claim was denied or underrated, you still have a path forward.

Focus on these three options:

  • ✅ Higher-Level Review (no new evidence)
  • ✅ Supplemental Claim (add new evidence)
  • ✅ Board Appeal (formal review)

Pick the one that fits your situation—and make sure you’re solving the reason for the denial.
